DoorDash Faces Legal Action From In-N-Out For Delivering Burgers Without Permission

Even though DoorDash has been frequenting headlines for having partnered up with KFC for home delivery in the states, there is some foul news lurking near its window.

Burger chain In-N-Out is pressing legal action against the delivery start up with a demand of putting a stop to delivering its burgers. This mandate stems from rising concerns over food handling and misrepresentation of the brand.in nout

Filed earlier this month, the lawsuit by In-N-Out claims that DoorDash was never given the authority to deliver the concerned party’s burgers!

“Further, [In-N-Out] has no control over the time it takes [DoorDash] to deliver [In-N-Out]’s goods to consumers, or over the temperature at which the goods are kept during delivery, nor over the food handling and safety practices of [DoorDash]’s delivery drivers,” Fox News cites.

Further adding up to the number of complaints, In-N-Out is also charging the San Francisco based start up of disregarding In-N-Out’s trademark by using an “Imitation Logo” on the delivery service’s website.151112094713-in-n-out-doordash-540x304

Apparently, In-N-Out had tried toget in touch with DoorDash multiple times to request a full stop over selling their products, but while the third party service initially heeded to the request, it later on slapped on a fake logo and menu on its site.

 

DoorDash Responds

In response to the lawsuit, DoorDash issued a statement to Eater, which read:

“DoorDash uses its innovative logistics technology to deliver the very best food and products in neighborhoods across the country. While we have various relationships with different merchants, we are proud to help people get their favorite food delivered directly to their door.”

Despite DoorDash holding up a decent face in the industry, reports claim that several enterprises in Brooklyn and Manhattan have refused to tie up with the delivery service but their webpage still used their logos and menus without permission.doordash-square-red

In addition, DoorDash allegedly inflated original restaurant menu prices.
