ITC Takes Britannia To Court Over Similar Biscuit Packaging

According to a recent news report, ITC has filed a case against Britannia, arguing that Britannia’s new NutriChoice Digestive Zero biscuits packaging is very similar to ITC’s Sunfeast Farmlite Digestive All Good biscuit packaging.

The Lawsuit

ITC has filed a suit against Britannia Industries for the infringement of trademark and goodwill. ITC is also demanding that Britannia withdraw their product in its current packaging.

An ITC spokesperson confirmed that a case had been filed to the Economic Times and said that the case was ‘sub judice’.

The Biscuits In Question

Britannia launched its NutriChoice Digestive Zero biscuits which contain zero added sugar, zero maida and are high on fibres. They’re available for Rs.25 for 100 gram packs.

Meanwhile, ITC’s Sunfeast Digestive Farmlite All Good biscuits were launched a few months ago and are advertised as containing no sugar, no added maida and are made with Aashrivaad Atta whole wheat flour making thie biscuits rich in natural fibres.

While the selling point of both the biscuits is similar, a look at the packaging also reveals some similarities.

Both packets are yellow with a blue overlay and both display that there is no (or 0%) added sugar and maida prominently.

When contacted by the Economic Times, a Britannia spokesperson refused to comment.
