Mumbai Based Thali Restaurant Wins Case Against A Copycat Diner

Panchavati Gaurav is a popular name in Mumbai and this restaurant is known for its Gujarati and Rajasthani thalis. According to a report by DNA India, the restaurant has won a case against its copycat restaurant called Panchavati Raghav based in Nagpur. The trademark case was lost by the copycat diner and was levied a fine of Rs. 2 lakh according to the verdict by the Bombay High Court.

The case was filed by the owner of Panchavati Gaurav, Gaurav Chandak and asked for restraining orders against the copycat restaurant for using the registered trademarks of his restaurant. The case was filed against Ashwin Limbana who is the proprietor of Maa Nimishmma Foods in Nagpur. The representative of Chandak, Advocate Hiren Kamod told DNA India that the accused has been a franchisee of Panchavati Gaurav for five years and once the agreement ended, they started running Panchavati Raghav with a similar trademark.

After the judgement passed by Justice SJ Kathawalla, the copycat restaurant was told not to use the trademark of Panchavati Gaurav in any form. The defendants in turn have agreed not to use the label and will be removing them from the restaurant name, menu cards and all other printed material.

“This is a joint family business spread over three generations and over three decades, but there are also emotions attached to it. This is the first time we had to move the court to protect our goodwill that we have acquired over the years, by providing impeccable service to our patrons,” Chandak told DNA India. Kamod had pleaded for a fine of Rs.2 lakh on the defendant which was agreed to. “We plan to donate or use the amount for charity purpose,” Kamod explained to the publication.
